1. Acceptance and scope
These Terms of Use apply when you access or use PhinisiGO, including its websites, vessel profiles, destination pages, voyage guides and enquiry forms. By using the Platform or submitting an Enquiry, you agree to these Terms.
If you do not agree, do not use the Platform or submit an Enquiry. Separate terms apply to an Operator that claims or manages a listing, including the Operator Agreement accepted during activation.
2. Definitions
- Traveller means a person who uses the Platform to research a voyage or contact an Operator.
- Operator means the business or person responsible for offering, selling and operating a Vessel or Voyage.
- Vessel means a phinisi, liveaboard or other watercraft displayed on the Platform.
- Voyage means the charter, shared departure, cruise, diving trip or related travel service offered by an Operator.
- Enquiry means a request or message submitted through PhinisiGO and routed to an Operator.
- Platform means PhinisiGO's websites and associated online services.
- PhinisiGO, we, us or our means the service developed and operated by PT Martin Ind Group, Jakarta, Indonesia.
3. Our service
PhinisiGO is the Traveller's first point of contact for a Vessel Enquiry, and is not a party to the Voyage. We independently research, publish and promote Vessel listings. When a Traveller submits an Enquiry, PhinisiGO confirms availability and booking details directly with the Operator, then invites the Traveller to complete payment through PhinisiGO. A booking is confirmed once that payment is received. We earn commission from the Operator on bookings confirmed in this way, and settle the Operator's remaining share after commission. We do not operate Voyages, and the resulting travel agreement for the Voyage itself is between the Traveller and the Operator; PhinisiGO is not a party to that agreement or to the Voyage.
Once payment is received and a booking is confirmed, the Operator is responsible for issuing final voyage details, communicating operational requirements and delivering the Voyage. PhinisiGO is responsible for collecting the Traveller's payment and remitting the Operator's share after commission.
Any contract for the Voyage itself is made directly between the Traveller and the Operator on the Operator's own terms. Confirming availability and booking details with an Operator on the Traveller's behalf does not give PhinisiGO authority to bind an Operator to a booking or to operate the Voyage, and PhinisiGO does not guarantee that an Operator will accept an Enquiry or offer a particular price, route, date or service.
4. Enquiries
Submitting an Enquiry does not create a reservation, hold space, guarantee availability or require an Operator to provide a Voyage. PhinisiGO confirms availability and key booking details with the Operator before sharing a confirmed booking with the Traveller.
Travellers should not book flights, hotels, transfers or other connected arrangements until they have received confirmed booking details from PhinisiGO. A booking exists only once PhinisiGO has confirmed it with the Operator and shared it with the Traveller.
PhinisiGO confirms availability and key booking details with the Operator on the Traveller's behalf. Once shared with the Traveller, ongoing matters such as a final quotation, changes, additional services or contractual terms remain between the Traveller and the Operator on the Operator's own terms. Separately, PhinisiGO may continue to track a routed Enquiry for attribution and commission purposes, and may follow up with the Operator or Traveller for that purpose, including after a Voyage is confirmed. This ongoing tracking does not make PhinisiGO a party to the booking or the Voyage.
5. Traveller responsibilities
The Traveller is responsible for reviewing and complying with the Operator's requirements for themselves and all accompanying guests. These may include:
- Passport, visa, entry, health and vaccination requirements
- Diving qualifications, experience, medical declarations or activity waivers
- Travel, diving, medical evacuation and cancellation insurance
- Arrival at the agreed port, hotel, airport or meeting point on time
- Vessel rules, captain's directions and safety procedures
- Providing accurate guest, dietary, health and equipment information to the Operator
The Traveller must assess whether a Voyage is suitable for their needs and obtain independent medical, travel or insurance advice where appropriate.
6. Payment handling
This section is included as a commercial draft describing PhinisiGO's payment role and should be confirmed by Indonesian legal counsel, including any applicable payment services licensing requirements, before publication.
PhinisiGO collects the Traveller's payment for a confirmed booking, holds it, and remits the Operator's share after deducting PhinisiGO's commission. A booking is only confirmed once payment has been received in full or, where a deposit arrangement applies, once the required deposit has been received.
Payment methods, currencies, deposit terms, balance due dates, cancellation charges, amendments and refunds are confirmed as part of each booking. A Traveller should verify booking details directly with PhinisiGO before making any payment.
7. Cancellation and refund policy
This section is included as a commercial draft and should be confirmed by legal counsel before publication.
Once PhinisiGO confirms availability for a booking with the Operator, the deposit becomes non-refundable. This reflects that the Operator's time and cabin allocation have already been committed at that point.
The remaining balance is refundable if a Traveller cancels at least 30 days before the scheduled departure date. Cancellations made within 30 days of departure are non-refundable.
Where PhinisiGO or the Operator cancels a confirmed booking, including for weather, safety or vessel availability reasons, the Traveller receives a full refund of all amounts paid, regardless of how close to departure this occurs.
Refund timelines, and any operator-specific terms that apply in addition to this policy, are confirmed as part of each booking.
8. Listing and guide information
PhinisiGO may display information supplied by Operators, information gathered through independent research, or a combination of both. The Verification Record identifies the source or management status of relevant listing fields. A Vessel does not need to be claimed by an Operator to be listed, searchable, or able to receive Enquiries; claiming a listing is optional and gives the Operator direct edit access, but does not otherwise change how the listing is treated.
Operator-confirmed or Operator-managed does not mean that PhinisiGO has physically inspected the Vessel, audited the Operator, certified safety compliance or verified every document. Independently researched means the information was compiled from sources considered reasonably relevant at the time; it is not a warranty of accuracy or current validity.
Routes, prices, inclusions, specifications, permits, crew, safety equipment and operating conditions may change. Travellers must confirm all material details directly with the Operator before booking.
Voyage Guides and destination content are general planning information only. They do not replace current advice from an Operator, government authority, insurer, doctor or qualified travel professional.
9. Liability
To the fullest extent permitted by applicable law, PhinisiGO is not responsible for the acts, omissions, insolvency, representations or performance of an Operator or any other third party, or for the conduct, delay, alteration, cancellation, safety or outcome of a Voyage.
PhinisiGO is not liable for personal injury, illness, death, property loss, missed transport, additional accommodation, itinerary changes, weather disruption, force majeure, payment disputes or other loss arising from a Voyage or an agreement with an Operator, except where liability cannot legally be excluded.
We aim to present Platform information in good faith, but do not warrant that every listing, guide, price, date or route is complete, accurate or current.
To the fullest extent permitted by law, PhinisiGO will not be liable for indirect, incidental, special, consequential or loss-of-profit damages. If PhinisiGO is nevertheless found liable in connection with an Enquiry or Voyage, its aggregate liability will be limited to the commission actually received by PhinisiGO in connection with that booking, or, where no commission was received, IDR 1,000,000.

10. Complaints and disputes
A complaint concerning the Vessel, crew, itinerary, payment, cancellation, refund, safety or delivery of a Voyage must first be raised directly with the Operator as soon as reasonably possible.
A complaint concerning PhinisiGO itself—such as a broken Enquiry form, incorrect routing, account access or information displayed on the Platform—may be sent to info@phinisigo.com.
PhinisiGO may forward relevant communications to an Operator or review whether listing information should be corrected, but does not decide contractual disputes between Travellers and Operators.
11. Acceptable use
You must not misuse the Platform, interfere with its operation, submit false or unlawful information, impersonate another person, attempt unauthorised access, distribute malicious code, or use the Enquiry system for spam, solicitation or purposes unrelated to genuine voyage interest.
We may restrict or suspend access where reasonably necessary to protect the Platform, Operators, Travellers or PT Martin Ind Group.
12. Intellectual property
The PhinisiGO name, logo, interface, original text, structured listing presentation, verification framework, databases and other Platform materials are protected by applicable intellectual-property and database laws.
You may use the Platform for personal trip research and genuine business participation as an Operator. Without prior written permission, you may not commercially copy, reproduce, republish, scrape, crawl, extract, resell, mirror or create a competing database from Platform content.
Operator-owned photographs, trademarks and materials remain the property of their respective owners and are used subject to the permissions or lawful bases applicable to those materials.
13. Privacy
Personal data submitted through the Platform is handled in accordance with the PhinisiGO Privacy Policy. The Privacy Policy explains the data collected, enquiry routing, service providers, retention and available rights.
14. Governing law, language and jurisdiction
These Terms and the relationship between you and PhinisiGO are governed by the laws of the Republic of Indonesia.
PhinisiGO may provide English and Bahasa Indonesia versions. To comply with applicable Indonesian language requirements, the Bahasa Indonesia version will govern to the extent required by Law No. 24 of 2009 and other applicable law. Any translation is intended to convey the same meaning.
The parties should first attempt to resolve any dispute concerning the Platform in good faith. If it cannot be resolved, the dispute will be submitted to the competent courts of South Jakarta, Indonesia, unless mandatory law requires otherwise.
15. General provisions
If any provision is held invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver of the right to enforce it later.
You may not transfer your rights under these Terms without our written consent. PhinisiGO may transfer its rights and obligations as part of a lawful restructuring, transfer of the Platform or change in operating entity, subject to applicable law.
16. Changes to these Terms
PhinisiGO may update these Terms when the Platform, operating model or legal requirements change. The latest version will be published on this page with a revised date. Continued use after publication means the updated Terms apply to later use of the Platform.
